SERVICES
Outsourced Data Protection Officer
Independent advice, compliance monitoring and consistent coordination of data protection matters.
When is this service relevant?
For organisations required to appoint a Data Protection Officer (DPO), choosing to appoint one voluntarily or seeking support for an in-house DPO. We first discuss your operations, processing risks and the scope of support required.
Scope of support
- Assess the need for a DPO and potential conflicts of interest. Agree arrangements for independence, direct reporting to the highest management level and access to the necessary information.
- Agree when the DPO is involved in procurement, new projects and process changes, how advice is requested and who implements recommendations.
- Advise management and employees on lawful processing, transparency, vendors, contracts and international transfers.
- Prepare and carry out a compliance monitoring plan. Review selected processes, documentation and safeguards, giving priority to higher-risk activities.
- Provide independent advice on data protection impact assessments (DPIAs) and proposed safeguards, and monitor the performance of assessments.
- Advise on data subject requests and personal data breaches. Cooperate with the supervisory authority and act as its contact point.
- Advise on staff training, identify relevant topics and monitor data protection awareness within the organisation.
- Report to management on findings, their significance, proposed actions and progress in implementing previous recommendations.
How Outsourced DPO Services Are Delivered
Outsourced Data Protection Officer services may be delivered remotely, while ensuring the DPO's accessibility, appropriate involvement in matters relating to personal data protection and the effective performance of the functions required under the GDPR.
The engagement model, communication arrangements, meeting frequency and any necessary on-site involvement are agreed individually.
The DPO acts independently and does not determine the purposes and means of processing. The controller or processor remains responsible for meeting its GDPR obligations. Advisory support for an in-house DPO and appointment as an external DPO are distinct engagement models.
